1. Acceptance of these terms

Days Become ("Days Become", "we", "us") provides a tool for creating, decorating, and sharing photo calendars: a website and an iPhone app, together the "Service". By creating an account or using the Service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Who you are dealing with

Days Become is built and run by one independent developer based in the United States, operating as a sole proprietor rather than a company. There is no support department behind this address: mail to hello@daysbecome.com reaches a person, and that is the address for every question, notice, or legal matter in these terms.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Days Become. If you are under 18, you represent that you have a parent or guardian's permission.

4. Your account

You are responsible for activity on your account and for keeping access to your email secure, since we use email-based sign-in. You choose a username, which is public; you may not choose a username that impersonates another person or business, infringes a trademark, or is offensive. We may reclaim or change usernames that violate these rules.

5. Your content

You keep ownership of the photos, text, and designs you add to Days Become ("Your Content"). By posting Your Content, you grant us a worldwide, non-exclusive license to store, display, and reproduce it solely to operate and provide the Service to you and, if you make a profile or calendar public, to the people you share it with. You are responsible for Your Content and confirm you have the rights to use it.

6. Acceptable use

You agree not to use Days Become to upload, share, or link to content that is: illegal; sexually exploitative of minors; harassing, hateful, or threatening; infringing of others' intellectual-property or privacy rights; malware or spam; or that violates any law. You also agree not to attempt to break, overload, or reverse-engineer the Service. We may remove content and suspend or terminate accounts that violate these rules.

7. Copyright complaints

If you believe something on Days Become infringes a copyright you own or represent, email hello@daysbecome.com with: your name and contact details; a description of the work you say was copied; a link to the material on Days Become; a statement that you believe in good faith the use is not authorised by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them; and your signature, electronic or physical.We remove material that infringes, tell the person who posted it, and terminate the accounts of repeat infringers. If your material was removed and you believe that was a mistake, send a counter notice to the same address with the same details and a statement, under penalty of perjury, that you believe the removal was an error.

8. Subscriptions and payments

Some features may require a paid subscription. Pricing, billing cycle, and what's included are shown at the point of purchase. We never see or store your full card details.Where you subscribe decides who bills you and where you manage it. In the iPhone app, subscriptions are sold through Apple's App Store. Apple takes the payment, and you manage or cancel from your Apple account (on your iPhone: Settings, your name, then Subscriptions). On our website, subscriptions are processed by our payment provider, and you manage or cancel them from your account settings on the site. The app does not sell subscriptions any other way.Cancelling stops future renewals. You keep access until the end of the period you have already paid for. Unless required by law, payments are non-refundable. Refunds for App Store purchases are requested from and decided by Apple under its own policy, not by us.If you are a consumer in the EU or UK, you normally have 14 days to change your mind about something bought online. Digital services you asked to start immediately are an exception, and subscribing here is exactly that: you ask us to give you access straight away, and you accept that your cancellation right ends once we do. Statutory rights your local law does not let you waive are unaffected.If you subscribed on our website, deleting your account cancels it. Billing stops straight away and you will not be charged again. You will not be refunded for time you have already paid for, so if you are part way through a year, delete only when you are ready to give up the rest of it.If you subscribed in the iPhone app, deleting your account does not cancel it. Only Apple can cancel a subscription bought through the App Store. Cancel with Apple first, or you will keep being charged after your account is gone.

9. Termination

You may stop using Days Become and delete your account at any time. We may suspend or terminate your access if you violate these terms or if we discontinue the Service. On termination, your right to use the Service ends; we may delete Your Content after a reasonable period.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind. We do not guarantee the Service will be uninterrupted, error-free, or that your content will never be lost. Keep your own copies of anything important.

11. Limitation of liability

To the fullest extent permitted by law, Days Become will not be liable for any indirect, incidental, or consequential damages, or for loss of data or content, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places do not allow these limits, in which case they apply to you only as far as the law allows.

12. Indemnity

You agree to cover our reasonable costs, including legal fees, for any claim brought against us because of Your Content, your use of the Service, or your breach of these terms. This does not cover anything caused by our own acts or omissions.

13. If you use the iPhone app

These terms are between you and Days Become only, not Apple, which has no responsibility for the app or its content. Apple has no obligation to provide support for the app; support requests go to us, at the address below. If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim you or a third party has about the app, including product-liability, legal-compliance, and intellectual-property claims. You confirm you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Governing law

These terms, and any dispute arising out of them or your use of the Service, are governed by the laws of the United States and of the state in which Days Become is operated, without regard to conflict-of-law rules. You and Days Become agree to the exclusive jurisdiction of the state and federal courts of the place from which Days Become is operated. If you are a consumer, nothing here takes away the protection of the law where you live, and you may still bring proceedings there if that law entitles you to.

15. General

If any part of these terms is found unenforceable, the rest stays in force. Not enforcing a term is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between us about the Service. You may not transfer your rights under these terms; we may transfer ours if Days Become is ever sold or reorganised, and your rights are unaffected if we do.

16. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll notify you (for example, by email or in the app). Continuing to use the Service after changes take effect means you accept the updated terms.
